As Maltese politicians continue to debate on whether to discuss divorce or not, as Social Policy Minister John Dalli suggested in June, nine EU states are to demand the EU Commission for “enhanced co-operation” regarding a common law on divorce. These are France, Italy, Spain, Greece, Austria, Hungary, Slovenia, Luxembourg and Romania.

If the Commission accepts, the proposal will then have to be approved by a qualified majority of the bloc's 27 member states. Enhanced co-operation is seen by critics as a contradiction of the bloc’s unifying principles supporting a two-speed Europe.

The proposal for a common law is expected to be discussed during a meeting of EU justice and home affairs ministers in Brussels on Friday
