The Criminal Court ordered the case of 62-year-old Anthony Schembri from Birkirkara, charged with stabbing and causing the death of his estranged wife Doris, to be referred to the Magisterial Court.

The case will continue being heard after six out of nine jurors decided on Monday that Mr Schembri, a Sliema resident, was not in a confused frame of mind when  he stabbed the woman, recovered in Ward M4 at St Luke’s Hospital on the 29th September 2005.

The defence is expected to appeal from the decision.

The Court was presided over by Giannino Caruana Demajo.

Lawyers Edward Gatt and Anġlu Farrugia appeared for Mr Schembri.
