A female transsexual was given the go ahead to marry her partner on Thursday after the court ruled that the union between the transsexual and her male partner did not go against any provision of the Marriage Act.
This ruling is believed to be the first of its kind in
Malta.
The 25-year-old woman was born a man, however, after undergoing gender reassignment surgery last June she was officially declared a woman. The woman filed an application in the
Civil Court requesting the court to order the director of Public Registry to issue the marriage banns because she wanted to marry her male partner.
Mr. Justice Gino Camilleri, who presided over the court, ruled that the union between the transsexual, now a woman, and her male partner did not go against any provision of the Marriage Act.
The name of the woman and her partner cannot be published due to the private and sensitive nature of the case.
