A criminal investigation into the sexually explicit computer messages that former Rep. Mark Foley sent to former male congressional pages has been opened by Florida authorities.

Soon after the explicit e-mails were uncovered and Mark Foley resigned from Congress, he stated that he had been molested by a 'clergyman' when he was a youngster. Gozitan Fr. Anthony Mercieca had described a series of encounters he said Mark Foley might perceive as sexually inappropriate when speaking of the “intimate relationship” he'd had with the former Congressman in Florida in the 1960.

Kristen Perezluha, a spokeswoman for the Florida Department of Law Enforcement said that "It was a preliminary inquiry before, but we found the basis to open up a criminal investigation," according to PennLive.

The former congressman resigned on the 29th of September after the e-mails were uncovered. Mark Foley’s attorney, David Roth, has said Foley never had inappropriate sexual contact with minors. Florida law prohibits seducing or attempting to seduce a minor. However, authorities have said the term "seduce" is open to interpretation.
