Man freed after daughters retract rape accusation

A 49-year-old father has been freed from a five-year prison sentence, after his two daughters admitted that they had falsely accused him of sexually abusing them. The girls, aged 15 and 16, made their admission in front of the after the Court of Appeal on Tuesday.

The man, from Żurrieq, had been found guilty of corrupting the minors, holding the girls against their will and raping them. A five-year jail term had been handed down by Magistrate Miriam Hayman.

One of the girls changed her version of facts from the very beginning of the case, however, the other girl carried on insisting that the abuse had indeed taken place. However, she eventually admitted that her father had never effectively sexually abused either girl.

The Court, presided over by Justice David Scicluna, noted that the case was “characterized by a shocking amount of lies, conjectures and slyness”. The Court heard how one of the girls was forced to make up their story by her boyfriend. The girls had also run away from home, an escape which is believed to have been instigated by same boyfriend, identified as Stefan Cutajar. The court also heard how one of the girls was also forced into the life of prostitution.

Throughout the appeal, one of the girls had spoken to Lawyer Joseph M. Sammut and insisted that the retraction of her accusations had been in no way forced upon her.

Two home managers who had taken care of the girls in an institution when the case began were called to take the witness stand. Both home managers had expressed their doubts about the veracity of the girls’ claims.
